Types of compensation: annual aid payment or land repurchase.

A land owner whose property is located in a specially protected nature area or in a micro-reserve other than a protected nature area of European interest (Natura 2000), or located in a micro-reserve outside the Natura 2000 site, and the land property area in a micro-reserve is less than 1 hectare, may apply to the Natural Protection Board for compensation - an annual payment of aid for restrictions on economic activity on his or her property.
An annual aid payment shall be granted for the following restrictions on forestry activity:
1) any forestry activity is prohibited;
2) the felling of trees in the main felling and felling of care shall be prohibited;
3) the felling of trees in the main felling is prohibited;
4) felling of trees in felling shall be prohibited.

An annual aid payment shall be granted for the following restrictions on agricultural activity:
1) prohibited grubbing up and cultivation;
2) all types of economic activity shall be prohibited.

Land repurchases may be required if the land property is unbuilt and is located in the following specially protected nature area:
1) in a nature reserve;
2) specially protected nature areas in the nature reserve zone, in the strict regime zone or in the adjustable regime area.

Process description

  1. Service requests
    In order to request compensation - an annual aid payment, the land owner must submit to the Natural Protection Board an application form contained in the Annex to Cabinet Regulation No. 891 of 17 September 2013, Regulations regarding restrictions on economic activity for which compensation is due, conditions, procedures and extent of the cost thereof.
    Time limit for the submission of the application - 15 May.

    In order to request compensation - the land repurchase, the land owner or the heir must submit to the Natural Protection Board an application form contained in the Annex to Cabinet Regulation No. 1173 of 22 October 2013, Procedures for the Adoption of a Land Redemption Application.

    The refund request shall be examined if:
     land is owned by a number of owners, only all co-owners require compensation by mutual agreement;
    in conformity with the regulatory enactments regarding the procedures for forest inventory, a forest inventory file shall be in force for the  forest land area;
    real estate tax has been paid by  for the previous year and for the current quarter;
    a fine has been imposed on the owner of  land for environmental violations, as well as if damage has been caused to the environment or forest due to his or her fault, the request for compensation of that land owner shall only be examined when he or she has paid this fine in accordance with the procedures specified in the regulatory enactments regarding environmental violations and has reimbursed the damage caused to the environment and forest.

    An annual payment of aid or land repurchase shall not be eligible if the land owner has received compensation for a forest stand on the land, the lump-sum remuneration in accordance with the Law On the Right of landowners to Compensation for Limits on Economic Activities in Specifically Protected Nature Areas and Microreserves.

  2. Receipt of services
    The Natural Protection Board shall take a decision regarding the granting of an annual aid payment or the refusal to grant compensation within one month after receipt of the application.
    Within three months of the adoption of the decision on the granting of compensation, the payment of the compensation shall be secured where funds have been allocated to that purpose in the State budget.

    The Natural Protection Board shall take a decision regarding whether the land repurchase application is justified. After the taking of the referred to decision, the Natural Protection Board shall determine the land price in conformity with the Law on Expropriation of Real Estate Required for the needs of the Company. If the land owner agrees with the specified price, the Natural Protection Board shall prepare the information necessary in order for the Cabinet to take an order regarding the permit to redeem the land. After the Cabinet has taken an order regarding the permit to redeem land, the Natural Protection Board shall apply the procedures for the voluntary alienation of property specified in the Law on the alienation of immovable property necessary for the needs of the Society for the repurchase of land.
